Planning and Infrastructure

We can guide you through the respective processes and assist you with getting the requisite approvals.

1. Planning

  • We can work alongside your planning consultant or architect to carry out due-diligence in relation to the title to the property to enable you to assess whether the proposed development is viable. 
  • We can review plans, planning conditions and associated documents to ensure that they comply with the title and any other relevant constraints. 
  • You may require a Section 106 Agreement or a Unilateral Undertaking to make your planning permission acceptable to your Local Planning Authority. We can assist with this by preparing the necessary agreement in line with the Planning Authority’s Development Plan and Guidance, advising you in relation to the implications of and your obligations under the same. We can prepare and submit Certificates of Title in support of your application to the Local Planning Authority. 

2. Road Agreements  

  • We can work with your planners and civil engineers to ensure that the relevant estate road plans are suitable for the title in question. 
  • We can liaise with the Local Highways Department in relation to their requirements for connections into highway or the adoption of new roads. 
  • We can prepare, review and advise you upon the necessary Section 278, Section 38 Agreement or other similar agreements which may be required to ensure that the Local Highways Department will consent to the connection and/or procure the adoption of the road in due course. 

3. Sewers and other utilities 

  • We can liaise with your planners and civil engineers in relation to plans ensuring that these are suitable for the title in question. 
  • We can liaise with the utility companies and/or their solicitor in relation to their requirements and guide you through the process. 
  • We can prepare, review and advise you upon the necessary agreements, easements or grants that may be required by the utility company for them to service the property and can see these through to completion and registration at HM Land Registry on your behalf.
